Summary: Kanter v. Barr is a challenge to federal and Wisconsin statutes that prohibit individuals with felony convictions from possessing firearms. The plaintiff, Kanter, argues that the statutes as applied to him violate his Second Amendment right to bear arms.
Everytown filed an amicus brief in the United States Court of Appeals for the Seventh Circuit, urging the court to affirm the district court’s decision dismissing Kanter’s complaint. The brief explains that Kanter, as an individual with a felony conviction, is disqualified from exercising Second Amendment rights. It also demonstrates how the application of the firearm restrictions easily survives immediate scrutiny.
Decision: On March 15, 2019, the Seventh Circuit affirmed the district court’s decision.
